These terms and conditions become effective on May 29, 2026.
I. Basic Provisions
- The data controller pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR”) is Činka fitness s.r.o., Company ID 24276448, with its registered office at Neumannova 1453/28, 15600 Prague (hereinafter: the “controller”).

- Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
- The controller has not appointed a data protection officer.
II. Sources and Categories of Processed Personal Data
- The controller processes personal data that you have provided or personal data obtained based on your inquiry.
- The controller processes your identification and contact data, as well as data necessary for contract performance.
III. Legal Basis and Purpose of Personal Data Processing
- The legal basis for processing personal data is:
- performance of a contract between you and the controller pursuant to Article 6(1)(b) GDPR,
- legitimate interest of the controller in direct marketing (in particular sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
- your consent to processing for direct marketing purposes (in particular sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, if no order for goods or services has been made.
- The purpose of processing personal data is:
- handling your inquiry,
- sending commercial communications and carrying out other marketing activities.
- The controller does not carry out any automated individual decision-making within the meaning of Article 22 GDPR.
IV. Retention Period
- The controller stores personal data:
- for the period necessary to exercise rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these relationships (for 15 years after termination of the contractual relationship),
- for the period until consent to processing for marketing purposes is withdrawn, but no longer than 5 years if personal data is processed on the basis of consent.
- After the retention period expires, the controller deletes the personal data.
V. Recipients of Personal Data (Processors)
- Recipients of personal data are entities:
- providing website operation services,
- providing marketing services.
- The controller does not intend to transfer personal data to a third country (outside the EU) or an international organization. Recipients in third countries are providers of mailing services / cloud services.
VI. Your Rights
- Under the conditions set out in GDPR, you have:
- the right of access to your personal data under Article 15 GDPR,
- the right to rectification under Article 16 GDPR, or restriction of processing under Article 18 GDPR,
- the right to erasure under Article 17 GDPR,
- the right to object to processing under Article 21 GDPR,
- the right to data portability under Article 20 GDPR,
- the right to withdraw consent to processing in writing or electronically at the address or email of the controller stated in Article III of these terms.
- You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to data protection has been violated.
VII. Security of Personal Data
- The controller declares that it has implemented all appropriate technical and organizational measures to secure personal data.
- The controller has implemented technical measures to secure data storage and storage of personal data in physical form.
- The controller declares that only authorized persons have access to personal data.
VIII. Final Provisions
- By submitting an inquiry form, you confirm that you have been informed of the personal data protection terms and that you accept them in full.
- The controller is entitled to change these terms. The new version of the personal data protection terms will be published on its website and at the same time sent to your email address provided to the controller.
